U.S. Department of Labor Unveils New Joint Employer Rule This is the first significant update to the joint-employer rule in more than 60 years – a win for small businesses. The rule includes a four-factor balancing test to determine whether businesses share liability for FLSA wage and hour violations. To determine whether a second company is a joint employer of a worker, DOL will examine whether the presumed joint employer hires or fires the employee; supervises and controls the employee’s work schedule or conditions of employment to a substantial degree; determines the employee’s rate and method of payment; and maintains the employee’s employment records. Small business owners are no exception to being hit by scammers so every once in a while I'll share articles like these from the NFIB website. Another SMS Scam - PayPal Edition Cyber scammers do not limit their phishing attacks to your email inbox, they love texting your mobile device too. Their current text, or Short Message Service (SMS), scam uses PayPal as the bait. The text message claims to be from PayPal, and it states that there has been unusual activity detected on your account. If you click on the link in the text, you are taken to a phishing site that looks almost identical to PayPal’s login page. You are prompted to enter your email address and then your password. Once you have gotten this far, you are asked to enter your mother’s maiden name, your home address, and your financial details. Do not enter any of this information!
